ابعاد حقوقی و قانونی فرهنگ حمایت از بزه دیدگان در بررسی تطبیقی اسناد و قوانین بین المللی و ایران

زمینه و هدف: یکی از ابعاد مغفول‌مانده در نظام‌های سنتی، توجه به ابعاد حقوقی و قانونی فرهنگ حمایت از بزه دیدگان بوده است؛بررسی و تحلیل تطبیقی سیاست‌ها و مقررات مربوط به حمایت از بزه‌دیدگان در اسناد و قوانین بین‌المللی و ایران با هدف شناسایی نقاط قوت و ضعف موجود، راهکارهایی برای تقویت جایگاه بزه ‌دیده در فرآیند عدالت کیفری کشور و نهادینه سازی فرهنگ حمایت از بزه دیدگان فراهم می سازد.روش: پژوهش حاضر از نظر هدف کاربردی، از نظر ماهیت، توصیفی- تحلیلی و از لحاظ رویکرد، کیفی تطبیقی است که از روش تحلیل محتوا(کدگذاری سه مرحله ای) برای تحلیل آن استفاده شد.روش گردآوری داده‌ها، به صورت اسنادی و با استفاده از ابزار فیش‌برداری شامل 9 جلد کتاب، 18 نسخه مقاله، 6 سند قانونی و 8 سایت معتبر حقوقی بوده که به علت محدودیت منابع در حوزه اقدامات حمایتی از بزه‌دیدگان به صورت تمام شمار مورد مطالعه قرار گرفتند. یافته ها: قوانین ایران مانند قانون حمایت از بزه‌دیدگان ، قانون آیین دادرسی کیفری و... در راستای نهادینه سازی فرهنگ حمایت از بزه دیدگان حقوق اولیه‌ای برای بزه‌دیدگان فراهم کرده‌اند، اما نسبت به استانداردهای بین‌المللی نظیر «اصول حقوق بزه‌دیدگان» سازمان ملل متحد کاستی‌هایی دارند. به ویژه، مشارکت فعال بزه‌دیدگان در دادرسی و... که در فرهنگ حمایت از بزه دیدگان ایران محدودتر است. نتیجه گیری: هرچند قوانین ایران در راستای فرهنگ حمایت از بزه‌دیدگان گام‌هایی مثبت برداشته‌اند، اما با استانداردهای بین‌المللی فاصله قابل توجهی دارند.کاستی‌هایی نظیر مشارکت فعال بزه‌دیدگان در دادرسی‌ها و... ضروری است تا حقوق بزه‌دیدگان به نحو جامع‌تری تضمین شود.

Typology of fear among government managers and its consequences

Fear in organizational environments is a complex phenomenon that has important effects on decision-making, leadership style, and performance of managers. This study aimed to identify the typology of fear among managers and examine its individual, organizational, and supra-organizational consequences. The research method was qualitative and presented on semi-structured interviews with administrative managers in Hormozgan province. Sampling was done using the snowball method and data analysis was done using thematic analysis. The findings showed that managers' fears fall into five main categories: fear of judgment and social relationships, fear of failure and poor performance, fear of change and uncertainty, fear of control and power, and fear of responsibility and accountability. These fears lead to negative consequences such as psychological burnout, reduced innovation, weakening trust in employees, and economic recession. Also, factors that exacerbate (such as ambiguity in policies and environmental pressures) and inhibit (such as team support and clear communication) fear were identified. The results showed that proper fear management can turn it into a factor for individual and organizational growth. This research provides practical solutions to help organizations improve their productivity and performance by reducing the negative effects of fear.

Solutions for Regulating Labor Relations in the Platform Economy: Iranian Ride-hailing Platform Business

The emergence of Platform Businesses (PBs) has caused a conflict of interest between traditional and new economic players, so, based on the public interest theories to establish justice, the need for government intervention through regulation is highlighted. The research purpose is to extract regulatory challenges and solutions to the PBs in the field of labor relations. The participant's community includes all the stakeholders of the PBs, 24 of which were selected by snowball sampling, and semi-structured interviews with labor relations experts, academics in legal, economic, and regulatory fields, managers, and workers of transportation platforms were conducted. Thematic Analysis method was used to answer the questions. Results showed 8 main categories of labor relations challenges, which are Ambiguity in the concept of PBs; Market failure and the necessity of government intervention; Ambiguity in how to regulate; Necessity of amending the labor law and creating a special law of PBs; Reducing the bargaining power of platform workers; Weakness of HR systems; Weak social protection of platform workers' rights; Domination of the capitalist system. Also, five solutions were extracted. The fifth scenario -participation of all stakeholders in regulating the labor relations of PBs - was proposed to the practitioners and policymakers.

The Construction of Collective Memory in the Axis of Social Reality and Habitus

How is collective memory formed through interaction with individuals’ habits and reality? This question is important for us to understand how individuals’ social experiences and habituated internal behaviour functions in the formation of collective memory. In lıne with this question, ın this article, in which the ideas of Berger and Luckmann, who emphasise the importance of social construction in the formation process of social reality, and how ingrained tendencies direct behaviours and shape social interactions through habitus, the most important concept of Bourdieu’s sociological approach, are discussed, it is aimed to reveal how habitus and social reality affect collective memory. Clarifying the relationship between these three concepts is important for us to understand how social, cultural, conscious and unconscious, habituated and transmitted behaviours affect the behaviours of society and individuals in the formation stages of collective memory. The relationship between these three concepts has been revealed based on Berger and Luckmann’s social construction approach, which is important for the process of social reality, and Pierre Bourdieu’s concept of habitus. As a result of the study, it has been revealed that collective memory is a living and living system that is influenced by habitus and social reality, and is affected by the dynamic structure of habitus and social reality in the process of formation. This article aims to contribute to the literature by explaining how collective memory, which is a process of remembering, is shaped by habitus and social reality while reaching a collective structure.

الگوی سبک زندگی تمدن ساز از دیدگاه حضرت امام خامنه ای(مدظله العالی)

تمدن اسلامی، درطول تاریخ اسلام دچار فراز و فرودهای بسیاری شده، اما با طلوع انقلاب اسلامی ایران و بیداری اسلامی در کشورهای مسلمان دوباره مورد توجه قرار گرفته است. در این میان، چگونگی ایفای نقش سبک زندگی اسلامی در تمدن­‌سازی اسلامی به­‌عنوان مهم­‌ترین مسأله در بین مؤلفه­‌های فرهنگی برای تکامل روند تمدن‌­سازی مطرح است. روش انجام این پژوهش، ازنظر هدف، کاربردی و ازنظر شیوۀ انجام، از نوع تحلیل اسنادی در چارچوب نظری امام خامنه‌­ای(مدظله‌­العالی) است که ابعاد، مؤلفه‌­ها و شاخص­ها از مضامین بیانات و فرمایشات معظم­له با کمک نرم افزارMAXQDA20  استخراج گردیده‌­اند.  با تحلیل 283 مضمون از بیانات معظم‌­له، به تعداد 3 بعد (بینشی، رفتاری، روشی)، تعداد 9 مؤلفه (الزامات حکم­رانی در سبک زندگی، تعلیم و تربیت، جلوگیری از نفوذ دشمنان، علم و دانش، عناصر استحکام و وحدت و انسجام اسلامی، قدرت و امنیت ملی، مشارکت­‌های مردمی، مقاومت و ایستادگی و نمادهای ابزاری سبک زندگی) و تعداد 83 شاخص برای این مؤلفه­‌ها استخراج گردیده است. نتیجه این است که نقش سبک زندگی در تمدن­‌سازی عصر حاضر که دنباله‌­رو تمدن اسلامی گذشته است با سیاست‌­گذاری فرهنگی درست در حوزۀ سبک زندگی اسلامی علاوه­‌بر این که کشور را به سمت یک زندگی بهتر و متمدن سوق می­‌دهد، می­‌تواند در احیاء، اصلاح و تحقق تمدن اسلامی پیشین نقش پیشران و جنبش نرم­‌افزاری را ایفا نماید.

The impact of neuromarketing on consumer behaviour

One of the biggest interests for companies in today’s market is considered consumer preference, why they make the choice of one product over another. The main aim of this study is to analyse the impact of neuromarketing in the process of identifying the preferences and needs of consumers. Neuromarketing tools provide insights into measuring the effectiveness of advertising campaigns in making an impact on the consumers in online retailing (Singh, 2020). In this study, neuromarketing has been analyzed, understanding the structure of the brain and its functions, the importance of perception, as well as consumer behavior during the purchasing process. In general, it is assumed that these choices are developed in a logical way, selecting the option that represents the greatest utility (Blazquez-Resino, Gutierrez-Broncano, & Gołąb-Andrzejak, 2020). The method used for primary data collection is the questionnaire, which addresses elements that are important in choosing a product for a customer. This study concludes that neuromarketing contributes to the discovery of consumer preferences thus helping companies to be closer and meet the needs of consumers. رابطۀ سبک‌های فرزندپروری والدین با تعارض والد-نوجوان و مسئولیت‌پذیری در نوجوانان

پژوهش حاضر، با هدف بررسی رابطۀ سبک­‌های فرزندپروری والدین با تعارض والد-نوجوان و مسئولیت‌­پذیری در نوجوانان انجام گرفت. روش پژوهش پیش‌رو، توصیفی-همبستگی بود و جامعۀ آماری آن را کلیۀ نوجوانان مراجعه‌­کننده به مرکز مشاوره و مددکاری فرماندهی ­انتظامی استان همدان که 250 نفر بودند، تشکیل دادند که از این جامعه، به­‌شیوۀ نمونه­‌گیری تصادقی ساده، 112 نفر، شامل 56 پسر و 56 دختر برگزیده شدند. به­‌منظور گردآوری داده­‌های مورد نیاز، از ابزار پرسشنامه استفاده گردید. یافته‌­ها نشان داد که میزان بالای کیفیت سبک‌­های فرزندپروری والدین با تعارض والد-نوجوان پایین نوجوانان و میزان بالای کیفیت سبک­‌های فرزندپروری والدین با مسئولیت‌­پذیری بالای نوجوانان همبستگی دارد.

تأثیر سرمایۀ فرهنگی بر خشونت اجتماعی

هدف این پژوهش، بررسی تأثیر سرمایۀ فرهنگی بر خشونت اجتماعی در بین جوانان شهر مشهد است. پژوهش حاضر، ازنظر هدف، کاربردی و ازحیث جمع‌آوری داده‌ها، توصیفی و از نوع پیمایشی به­‌حساب می­‌آید. جامعۀ آماری این پژوهش را جوانان 15 تا 29 سال ساکن شهر مشهد تشکیل دادند که از بین آن­ها، به‌­­روش نمونه‌گیری چندمرحله‌ای با استفاده از فرمول کوکران با معیارهای نامعین، تعداد 402 نفر به‌عنوان نمونه انتخاب شدند. با توجه به پیمایشی­‌بودن پژوهش، به­‌منظور جمع­‌آ‌وری داده‌­ها ابزار پرسشنامه مورد استفاده قرار گرفت و از روش تحلیل همبستگی و رگرسیون در نرم‌­افزار spss برای تحلیل داده‌­ها بهره برده شده است. نتایج حاکی از آن است که بین ابعاد سرمایۀ فرهنگی (عینیت‌یافته، جسمیت‌یافته و نهادینه‌شده) و خشونت جوانان، رابطۀ معناداری وجود دارد. به‌­علاوه، متغیر سرمایۀ فرهنگی جسمیت‌یافته با (350/0) درصد، سپس متغیرهای سرمایۀ فرهنگی نهادینه‌شده با (305/0-) درصد و متغیر سرمایۀ فرهنگی عینیت‌یافته با (290/0-) درصد به‌­صورت مستقیم بر خشونت اجتماعی جوانان تأثیرگذار است.

Algılanan Gelecekteki İstihdam Edilebilirlik Ölçeğinin Türkçeye Uyarlanması

Bu çalışmanın amacı Algılanan Gelecekteki İstihdam Edilebilirlik Ölçeği’nin (AGİEÖ) Türkçeye uyarlanarak üniversite öğrencileri için geçerlik ve güvenirliğinin incelenmesidir. Araştırmanın çalışma grubunu Karadeniz Bölgesi’nde bulunan iki üniversitede öğrenim gören 461 öğrenci oluşturmaktadır. AGİEÖ’nün geçerlik çalışması kapsamında doğrulayıcı faktör analizi yapılmış, yakınsak ve ayırt edici geçerlik ve eş değer ölçek geçerliği incelenmiştir. Doğrulayıcı faktör analizi sonucunda orijinal yapıdaki gibi altı faktörlü yapının uyum indekslerinin kabul edilebilir değerlerde olduğu belirlenmiştir. Benzer şekilde, yapılan hesaplamalar sonucunda ölçeğin yakınsak ve ayırt edici geçerliği sağladığı görülmektedir. Eş değer ölçek geçerliği sonucunda da AGİEÖ’nün alt boyutları ile Kariyer Uyum Yetenekleri Ölçeği’nin alt boyut ve toplam puanları arasında pozitif yönde istatistiksel olarak anlamlı ilişkiler bulunmuştur. Diğer yandan AGİEÖ’nün eğitim kurumunun beklenen itibarı alt boyutu ile Kariyer Stresi Ölçeğinin toplam ve olumsuz duygular alt boyutu arasında negatif, düşük düzeyde anlamlı ilişkiler bulunmuştur. Ölçeğin toplam ve alt boyutlarına ilişkin Bileşik Güvenirlik ve Cronbach Alfa iç tutarlılık katsayılarının yeterli düzeyde olduğu bulunmuştur. Algılanan Gelecekteki İstihdam Edilebilirlik Ölçeği’nin üniversite öğrencilerinin gelecekteki becerilerini, deneyimlerini, iletişim ağlarını, kişisel özelliklerini iş gücü piyasası hakkındaki bilgilerini ve eğitimini tamamlayacakları üniversitenin itibarı hakkındaki algılarını ölçmede yeterli geçerlik ve güvenirlik değerlerine sahip olduğu söylenebilir.

اثرات درمانی و پروفیلاکتیک کورکومین بر مسمومیت حاد کبدی ناشی از تجویز مبندازول در سگ‌های پلیس مبارزه با مواد مخدر (نژاد ژرمن شیپرد)

پژوهش حاضر با هدف بررسی اثرات درمانی و پروفیلاکتیک کورکومین بر مسمومیت حاد کبدی ناشی از تجویز مبندازول در سگ­های نژاد ژرمن شیپرد انجام پذیرفت. در این پژوهش 20 قلاده سگ به­طور تصادفی به 4 گروه تقسیم شدند. سگ­های گروه A روزانه 150 میلی­گرم بر کیلوگرم مبندازول همزمان با مصرف غذا، به شکل خوراکی و داخل کپسول ژلاتینی دریافت کردند. سگ­های گروه B، روزانه 500 میلی­گرم بر کیلوگرم کورکومین و 150 میلی­گرم بر کیلوگرم مبندازول همزمان با مصرف غذا، به شکل خوراکی و داخل کپسول ژلاتینی دریافت کردند. سگ­های گروه C و D نیز مشابه گروه دوم تحت تیمار قرار گرفتند؛ با این تفاوت که به ترتیب 2 و 24 ساعت پس از مصرف مبندازول، کورکومین دریافت کردند. آنزیم­های ALT، AST، ALP و LDH در همه گروه­ها اندازه­گیری شد. در سگ­های گروه A، غلظت سرمی آنزیم­های ALT، AST،ALP و LDH به­طور معنی­داری پس از 24 ساعت افزایش یافت (05/0>P). مقادیر آنزیم­ها در گروه­های B، C و D  کاهش یافت اما تأثیر آن فقط در گروه D  معنی­دار بود و غلظت آنزیم­ها در محدودة نرمال قرار گرفت (05/0>P). نتایج این پژوهش نشان داد که کورکومین به­صورت معنی­داری، دارای اثرات درمانی در مقابل مسمومیت حاد کبدی ناشی از تجویز  مبندازول است.

The Significance of Organizational Culture and Leadership Behaviour on Organizational Success

This study examines the interconnection between organizational culture, leadership behaviour and organizational success and create an empirical link based on data drawn from one of Nigeria’s Cement Manufacturing Companies. This research was conducted using the quantitative method across the staff in the selected company. Semi-structured questionnaires were distributed to a population sample of 63 participants. From the results, there exists a significant relationship between these three elements while the organizational cultural type and style of leadership enforces the existing relationship. It was discovered that organizational culture which refers to the beliefs and values that have existed in an organization for a long time, and to the beliefs of the staff and the foreseen value of their work that will influence their attitudes and behaviour. We established that administrators or top management officers tend to modify their leadership behaviour to achieve the organization’s goals which in turn often influence job satisfaction on the part of the employee. It was also ascertained that there was a positive link between organization culture, leadership behaviour and organizational success. Findings also revealed that the culture of the organization has a two-way effect on the success of the organization, likewise the leadership traits and behaviour.

The Role of Price and Promotion in Creating Brand Equity

The purpose of this study is to ascertain the influence of price and promotion on brand equity, which eventually leads to the determination of consumer’s preference for a particular brand. This research aims to add value to the current field by testing this relationship under the influence of three other mediating dimensions including the brand image, brand loyalty and quality of the product. In order to test the proposed model, the Structural Equation Modeling technique was used in this study. Within this realm, the CFA and path analysis were used to assess the validity and reliability of the latent constructs. The results of the research revealed that the price and promotion of a particular product have a statistically significant relationship with its brand equity. The results also seem to reject the mediating effect of brand image, perceived quality and brand loyalty between price and brand equity. The relationship of promotion, however, does allow for mediation by the perceived quality of a brand, but rejects the other two hypotheses. A number of researchers in Pakistan have previously conducted research on brand equity, albeit using different predictors in different industries. It must be noted that this proposed model of price and promotion, and its effects on the brand equity has not been thoroughly tested in the Pakistani context. Hence, this study proves to be a preliminary basis for further research on the linkages between price, promotion actions and brand equity.

Kendilik Değerlendirmeleri ve İş Yükü Fazlalığının Mesleki Haz Üzerine Etkisi: Avukatlar Üzerine Bir Araştırma

Bu çalışmanın temel amacı, kişisel bir değişken olan kendilik değerlendirmeleri ile örgütsel bir değişken olan iş yükü fazlalığının, mesleki tatmin üzerindeki etkisini bütünsel bir model aracılığıyla ortaya çıkarmaktır. Bu doğrultuda araştırma 482 avukattan anket yöntemiyle ve uygun ölçeklerle elde edilen verilerle gerçekleştirilmiştir. Araştırma sonucunda elde edilen bulgular çerçevesinde, kendilik değerlendirmesi ile mesleki tatmin arasında aynı yönlü, iş yükü fazlalığı ile mesleki tatmin arasında ise aksi yönlü ilişki olduğu tespit edilmiştir. Bunun yanı sıra; kendilik değerlendirmelerinin mesleki tatmini aynı yönde etkilediği diğer taraftan, iş yükü fazlalığının mesleki tatmin üzerinde herhangi bir etki yaratmadığı belirlenmiştir.

Financial Sophistication, Personality and Stock Market Participation: Theory and Evidence

In this empirical study, the authors examined the extent to which financial sophistication and personality effects stock market participation. Using archival research methodology, our hypothesis has been tested on a random sample of 451 stock market participants. Moderation has been tested through Andrew Hayes process. Extroversion and openness to experience positively impact stock market participation, while consciousness, agreeableness, and neuroticism have a negative impact. Financial literacy, trading experience and gender are the likely paths by which personality impacts stock market participation. Financial literacy can modify the relationship between some basic personality traits and stock market participation. It shows that behavior finance is not completely predetermined by one’s DNA and also identifies which traits are less influenced by financial literacy. Perhaps this implies that these traits are more predetermined by one’s innate characteristics. This study provides an interdisciplinary contribution by extending Big Five taxonomy as a viable approach for stock market participation. Future research may investigate the impact of family resources, investment exposure, and parent’s financial literacy, which were beyond the scope of the current study. The theoretical and practical implications of the study with respect to stock market participation are discussed.

Bir Oto-Biyografi Üzerinden Otantik Liderliği Yorumlamak: Turgut Uzer’in Olymp ve Faniler Kitabı

Biyografiler birer yaşam öyküsü olarak, liderin yetkinliklerine ilişkin ilk elden veri sağlaması açısından liderlik çalışmaları için önemlidir. Lider biyografilerinden, bir liderlik kuramını açıklamak ya da geçerliliğini test etmek gibi farklı amaçlar için yararlanılmaktadır. Otantik liderler; kim olduğunu iyi bilen, değer yargıları ve davranışları arasında tutarlılık olan, dürüstlükleri ile tanınan ve bu nedenle saygı duyulan kişilerdir. Otantik liderliğin, farklı durumlarda ve farklı kültürlerde nasıl oluştuğunun incelenmesi amacıyla Turgut Uzer’in oto-biyografisi Olymp ve Faniler ana anlatı olarak ele alınmıştır. Analiz bulguları, otantik liderliğin özellikle kendini tanıma ve ilişkilerde açıklık boyutlarına ilişkin göstergeleri içermektedir. Leader biographies, as life stories, provide first-hand data for leader’s competencies and they convey key information for leadership studies. Leadership biographies might be helpful in two ways: To explain or to test the validity of a leadership theory and to support individual development as increasing the self- awareness through the selected life stories. Authentic leaders are; aware of their own values and behaviors, consistent with their values and behaviors, known as honest and therefore respected individuals. The auto-biography of Turgut Uzer’s Olymp and Mortals is considered as the major narrative to analyze and understand how authentic leadership exists in different situations and cultures. Findings indicate genuine examples of authentic leadership dimensions, especially awareness, transparency in relationships and openness.

Çalışma yaşamındaki üç kuşak arasında (Bebek Patlaması Kuşağı, X ve Y Kuşağı) önemli farklılıklar olduğu görüşü; bazı araştırmacılar, yönetim danışmanları ve popular medya tarafından sıklıkla dile getirilmeye başlanmıştır. Ancak kuşak farklılıklarına dair sistematik araştırmalar hem oldukça kısıtlı hem de bunların çoğu ABD kökenlidir. Bu çalışmanın amacı; çoklu kuşak kuramından hareket ederek, farklı kuşaklara mensup işgörenlerin, iş ve örgüte ilişkin temel tutumlarının (örgütsel bağlılık, iş tatmini ve örgütsel vatandaşlık davranışı), bireysel değerlerinin ve iş ahlâkı değerlerinin farklılaşıp farklılaşmadığını tespit etmektir. Araştırmanın hipotezleri, Ankara’da yedi farklı iş kolunda istihdam edilen 731 işgörenden toplanan verilerle MANCOVA analizi kullanılarak test edilmiştir. Yapılan analizler neticesinde, 18 araştırma hipotezinden sadece üçü desteklenmiştir.  Araştırma bulgularına göre, yalnızca duygusal bağlılık ve iş ahlâkının “boşa zaman geçirmeme” boyutu bakımından kuşaklar arasında anlamlı farklılıklar olduğu tespit edilmiştir. Kuşaklar arası farklılıklara ilişkin zayıf kanıtlar elde edildiğinden, kuşakların değer ve tutumlarının farklı olduğuna dair yaygın olan algı destek bulmamıştır. Ayrıca, ABD kökenli kuşak sınıflandırmasının, Türkiye bağlamında geçerliliğinin kuşkulu olduğu söylenebilir.
