Workplace integration of undergraduate student nurses through clinical placement remains an integral part of nurse education. The role of clinical facilitators who support this integration is complex and shaped by the expectations of various key stakeholders. These multiple expectations often resulting in the role being blurred and lacking clarity. The research aim is to identify the roles and expectations of clinical facilitators from the perspectives of academics/educators and students and to explore qualities that allow clinical facilitators to conduct their role effectively. A cross-sectional survey was utilised. Exploratory factor analysis, free text data and comparative analysis were used. Findings suggest a discordance in understanding of the clinical facilitator role by educators and students. Students tended to focus on skills and knowledge without consideration of the broader nursing profession. The clinical facilitator’s ability to role model and influence is seen as a “hidden curriculum” that students are largely unaware of. The clinical facilitator role is complex, with education critical in supporting this role and thus the success of students. Illumination of the hidden nursing curriculum would enable better understanding of the clinical facilitator role in engaging students with the varying requirements of the nursing profession.

The purpose of writing gender is to determine the range of legal relations included in the subject of national security law and military law. Criteria for the selection of branches of law are investigated. Attention is focused on theoretical approaches to understanding the structure and subject of national security law. The definition of the concept of military law is proposed. Arguments are given that the subject of regulation of military law is military legal relations, which are of a recurring nature and are the subject of a special type of control. The rationale is that the social necessity for the existence of military law is due to the long-term conduct of military (combat) operations on the territory of our state, the occupation of a significant part of the territory of Ukraine, the need to strengthen military formations to increase the level of defense capability and adequately rebuff the armed aggression of the Russian Federation, as well as solve problems adapting the functioning of the military organization of the state according to the standards of the North Atlantic Alliance. The article determines that the subject of military law is military legal relations, which are public relations regulated by legal norms that arise during the functioning of military formations, preparation for defense and implementation of the protection of the state in the event of armed aggression or armed conflict. A feature of military legal relations is their complex nature, which determines their simultaneous belonging to both the sphere of public law and private law relations. Attention is focused on the fact that the share of public law relations in the subject of military law is much larger. The conclusion is made that the definition of the subject matter of national security law and military law makes it possible to achieve stability in the formation of its doctrine and improve the quality of rule-making activities aimed at filling numerous legal gaps.

The millennial and generation Z tend to experience the negative impact of the decoy effect, so a consumer protection law is required. The purpose of this study is to demonstrate the negative impact of the decoy effect and the importance of consumer protection through digital literacy. A quantitative descriptive approach was used with millennial and generation Z research subjects who were given a choice of products using bait items. According to the study's findings, respondents are susceptible to the decoy effect, so consumers have the right to know before making a decision. The findings of this study contribute to the public's understanding and provision of suggestions or criticism, as well as to the government's formulation of consumer protection policies, particularly for the millennial and generation Z generations. The implication is that existing consumer protection laws must be flexible, rational, and based on digital literacy. Legal certainty as a form of consumer legal protection to achieve equality in an engagement as a concept for those who make transaction.

Using the example of the Kursk province, the article examines the main methods of government work with persons with dubious «political reliability», «potential» and «real» political criminals in the second half of the XIX - early XX centuries. This paper examines the types (investigative, judicial and administrative) of police supervision. Special attention is paid to the analysis of the public and secret (secret) modes of police surveillance. During the period under review, persons who, by their behavior, gave any reason for distrust (in political terms) were subject to secret (secret) supervision. Persons whose «political unreliability» was established «officially» were subordinated to public police supervision, but the decision of the authorities recognized that stricter measures of state coercion could not be applied to these persons to correct them. The study also provides grounds for establishing supervision over persons with questionable «political reliability», describes the mechanisms of interaction between different departments of the Kursk province that monitor the political situation in the region, the activities of «potential», «real» political criminals. At the end of the study, conclusions were drawn about the role of police surveillance (both public and secret) in the system of punitive and protective measures.

A pandemia de COVID-19 é um desastre sanitário e biológico, e, por isso, se aproxima, por um lado, do Direito dos Desastres e, por outro, do Direito Humanitário, enquanto um ethos de proteção e com vistas a evitar sofrimento. A aproximação com o Direito Humanitário – na acepção mais ampla deste, de não apenas o Direito que regula os conflitos armados, mas também enquanto um ramo jurídico que apresenta normas e ações voltadas ao atendimento de indivíduos em situações de crise humanitária - deve ser considerada no desenho e na implementação de respostas e estratégias de enfrentamento à pandemia. A partir dessa abordagem, temas como assistência humanitária e assistência ao desenvolvimento passam a coexistir com questões tradicionais do Direito dos Desastres, como gestão de riscos e prevenção ganham destaque. O presente trabalho busca explorar essas possibilidades, a partir de um referencial teórico de Direitos Humanos, Direito Humanitário e Direito Internacional.

Perlindungan Hukum terhadap investor/nasabah yang melakukan transaksi Perdagangan Berjangka meliputi hak dan kewajiban para pihak baik itu pihak nasabah yang dirugikan maupun pihak Perusahaan Pialang yang harus memenuhi tanggung jawab akibat kerugian yang dirasakan nasabah. Dalam penelitian ini menggunakan metode penelitian kepustakaan yuridis normatif yang di dalamnya menjelaskan mengenai kontrak yang diatur dalam UU No.10 tahun 2011 serta peraturan Bappebti yang belum seimbang mengatur hak dan kewajiban para pihak. Oleh karna itu dalam jurnal ini mengupas mengenai perlindungan hukum terhadap nasabah yang mengalami kerugian dalam transaksi forex serta penyelesaian sengketa secara administratif, perdata maupun pidana sesuai dengan pedoman Perundang-undangan yang berlaku. This paper is focused on the legal regulation of the employee monitoring and the control of employees in the legal order of the Czech Republic. In a commentary form, the paper deals with the Section 316 (1) to (3) of the Act No. 262/2006 Coll. Labour Code. This provision states: Without the employer’s consent, employees may not use the means of production and working means of the employer including computer technology and the employer’s telecommunication equipment for their personal needs. The employer shall be authorised to control the compliance with the prohibition stipulated in the first sentence in an appropriate way. The employer may not, without serious reasons consisting in a special character of the employer’s activities, infringe on privacy of an employee at the employer’s workplaces and common premises by subjecting the employee to open or secret monitoring, tapping and recording his/her telephone calls or controlling the emails or letters addressed to the employee. If there is a serious reason with respect to the employer consisting in a special nature of the employer’s activities which justifies introduction of control mechanisms mentioned above, the employer shall be obliged to inform directly the employee on the scope and the manner of performance of the control.

Resumen: Las políticas europeas de inmigración y refugio han sido criticadas por quienes las consideran emblemas de una concepción que pone en grave riesgo elementos básicos del Estado de Derecho y aun de la democracia. El epítome es la aparición de mercados de esclavos en Libia, a las puertas de la UE, un Estado fallido que la UE y sus Estados miembros se empeñan en elevar a la condición de partner privilegiado de sus políticas de externalización. Tomando como base los análisis de Lochak, Agambem y Bauman y la concepción de la propuesta por el filósofo camerunés Mbembé, desarrollando tesis de Foucault (biopolítica), se proponen algunas alternativas que vienen presididas por la exigencia de reconocimiento y garantía de derechos básicos de inmigrantes y refugiados. Abstract: European immigration and refuge policies have been criticized by those who see them as emblems of a conception that puts in serious risk basic elements of the Rule of Law and even of democracy. The epitome is the emergence of slave markets in Libya (at the gates of the EU), a failed state that, nevertheless, the EU and its Member States are determined to raise to the status of privileged partner of their outsourcing policies. Based on the analysis of Lochak, Agambem and Bauman and the conception of the proposed by the Cameroonian philosopher Mbembé who develops Foucault's thesis about biopolitics, this text will propose some alternatives that are leaded by the requirement of recognition and guarantee of rights of immigrants and refugees.

Se analizó si existe o no una transformación del sistema de fuentes del derecho, sumergiéndonos en el sistema escrito colombiano, luego en la reinterpretación que ha dado la Corte Constitucional al artículo 230 superior y por ultimo estudiando la figura de la unificación de la jurisprudencia, de acuerdo a las cambios legales y jurisprudenciales, que han tenido como resultado el establecimiento de un sistema fuerte del precedente en Colombia. Luego la evolución de la obligatoriedad del precedente judicial, emitido por la Corte Constitucional, como del Consejo de Estado, gracias a la expedición de leyes recientes y de la tesis planteada por el Tribunal Constitucional y tercero, un examen del valor del precedente bajo algunos principios del derecho administrativo colombiano, tales como la legalidad, igualdad y seguridad jurídica y por ultimo obligatoriedad del precedente judicial en el nuevo procedimiento administrativo colombiano y las consecuencias de no aplicarlo por parte de funcionarios judiciales y de las autoridades administrativas.

Suicide by power saws (bland, chain, circular or router saw) are an extreme exception. A few case reports are published in forensic literature regarding it. We report the case of a 30-year-old carpenter found dead lying on the floor next to a router saw in his carpenter workshop, with two gaping and deep wounds in his head. We summarize the findings of the death scene examination, the forensic autopsy, and the world literature concerning suicide committed with power saws.

Abstract Prohibition or restriction is necessary for large enterprises as legal safeguards for small businesses. It has been defined in the Act No. 5 Year 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition, which is also set out in Article 33 of the Constitution of the Republic of Indonesia of 1945 in which the state holds a national economy based on economic democracy. Article 33 paragraph (4) NRI 1945 Constitution states that: "The national economy shall be conducted in accordance with the principles of economic democracy, efficiency, justice, sustainability, environmental friendliness, independence, and balancing the economic progress and national unity". Hal ini telah ditentukan dalam Undang-Undang No. 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat, yang mana juga ditetapkan dalam konstitusi Pasal 33 Negara Republik Indonesia Tahun 1945 dimana negara memegang perekonomian nasional berdasarkan demokrasi ekonomi. Si la autonomía territorial con que cuentan los entes locales para la “gestión de sus intereses” permite fundar, vía una cláusula general de competencia, las iniciativas económicas locales, esta fórmula aparece sujeta a los límites constitucionales y legales sobre las modalidades de intervención local, como lo sugiere el respeto de las normas nacionales en materia de competencia económica.
